When it comes to consumer privacy, all marketing offers — such as direct-mail pieces or telemarketing scripts — must comply with both government regulations and marketing industry guidelines. Therefore, when an order includes data elements that are sensitive in nature, a review of the marketing offer is required. These sensitive areas include the following:

  • Children's data, including but not limited to, age, date of birth, gender, presence of children
  • Adult's full date of birth — MMDDCCYY
  • Health/Ailment data or prescription/medical data
  • Specific income amount (not ranges)

In addition to government regulations, Experian® uses the Direct Marketing Association guidelines and its own view of marketing offer best practices as the standard for these reviews. If Experian believes that a marketing offer violates these standards, we will contact you to resolve the issue. We may, for instance, provide recommendations for alternate wording. However, these recommendations should not be considered legal advice.
